The following terms and conditions listed below will apply between you and bowlstrader.co.uk for the purchase of items for sale on the website (the “goods”) contained in your basket. These terms do not affect your statutory rights.

It is your responsibility to determine that the Products are suitable for you and acceptable by the governing body of your game. It is not our responsibility to do so.

Where the Site or any Submission made by any user includes views, opinions, advice and recommendations, these views, opinions, advice and recommendations are not endorsed by us and we do not accept any liability on account of the accuracy, defamatory nature, completeness, timeliness or otherwise of such views, opinions, advice and recommendations.

We try to make sure that all information contained on the Site (and provided by us to you as part of any Services or Products) is correct, but the information is of a general nature and not intended to comprise of all the information relating to the subject matters referred to by the Site and therefore we do not accept any liability for any error or omission and exclude all liability for any action you may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this Site.

Our liability to you in connection with any Product purchased through the Website is strictly limited to the purchase price of that Product.

1. Bowls Trader

   3. Acceptance of Terms and Conditions

   3.1 By ordering goods from us you accept these terms and conditions. A legally binding contract between you and us will be formed when we send you an e-mail confirming we acknowledge your purchase of the goods from us. In the event of any change e.g. in price or expected delivery date we shall inform you and you shall have the right to either accept or reject such changes. The terms and conditions are subject to change at any time and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.

4. Liability

4.1 Bowls Trader does not seek to exclude or limit liability for:

(a) death or personal injury caused by our negligence or the negligence of our directors, employees, agents, or subcontractors,

(b) fraud or fraudulent misrepresentation,

(c) breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);

(d) breach of the terms implied by sections 13, 14 and 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and

(e) defective products under the Consumer Protection Act 1987.

and all exclusions or limitations of the liability of Bowls Trader which are set out in these terms and conditions shall always be subject to the provisions of this clause.

4.2 All descriptions, weights and dimensions of the goods on this website are those of the manufacturers and are intended only as a general guide. For the avoidance of doubt we accept no responsibility arising out of or in connection with the viewing, use or performance of our website or its content whether due to inaccuracy, error, omission or any other cause and whether on the part of Bowls Trader or our servants, agents or any other person or entity.

5. Suspension and Termination of Service

5.1 Bowls Trader may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or pages linked to it will not necessarily be uninterrupted or error free.

5.2 Bowls Trader may terminate the Service and cease to send you Products immediately in the event you breach any of these terms and conditions or if you are late in or do not pay any sums due to Bowls Trader.

6. Contract Formation

6.1 After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your Order has been accepted. Your Order constitutes an offer Bowls Trader to buy a Product via the Site (and Bowls Trader reserves the right to refuse orders for Products). No contract will exist in relation to the Products until we have confirmed to you by email that the Product has been dispatched (Dispatch Confirmation). Our acceptance to your offer will be deemed complete and the contract between us shall be formed when we send you the Dispatch Confirmation email.

7. Your Personal Information

7.1 Use of your personal information is governed by Bowls Trader’s Privacy Policy, which forms part of these terms and conditions. In the event that Bowls Trader undergoes reorganisation or is sold to a third party, you agree that any personal Bowls Trader holds about you may be transferred to that reorganised entity or third party and used in accordance with the Privacy Policy.

8. Prices

   8.1 Prices are displayed on the website in pounds sterling (£). The prices listed on the website are the current prices at the time of your order and we reserve the right to change prices on the website from time to time. We are not VAT registered so prices do not include VAT and it is not applicable to the sale.

   8.2 Delivery charges will be applied on an item-by-item basis and displayed at the checkout. Further details of our delivery charges can be found in the “delivery information” section.

9. Custom-Made Clothing Orders

   9.1 Custom-Made clothing orders are produced to order and are bespoke and therefore excluded from our returns policy, except in cases where we are deemed liable for shortages or damaged goods.

   9.2 By accepting these terms and conditions you understand and accept that full payment must be taken in advance for all Custom-Made clothing orders.

9.3 All Custom-Made clothing orders are non-refundable once the order has been confirmed with payment.

10. Ready-Made Clothing Orders

    10.1 Ready-Made clothing orders are returnable at the Buyer cost and liability. We accept no responsibility for goods not safely returned to us. The Buyer shall provide a proper invoice and despatch note number in respect of the Returned Goods.

10.2 By accepting these terms and conditions you understand and accept that full payment must be taken in advance for all Ready-Made clothing orders.

10.3 All Ready-Made clothing orders are refundable within a 28-day period from the date of purchase. See our “Returns and Refunds” clause for further information.

11. Colours

11.1 The colours on our website are a representation only and may vary from the actual garment(s). Variations in representation of colour(s) can differ between devices.

11.2 The Buyer accepts that every attempt will be made by Bowls Trader to match Custom-Made Clothing order colours as closely as possible, however, there may be some difference due to differences in computer and printer settings within the supply chain.

11.3 For Custom-Made Clothing order Bowls Trader uses a fabric colour swatch to achieve close colour matches and The Buyer accepts it will be at Bowls Trader’s discretion for this matching process.

11.4 In cases of repeat or follow-up Custom-Made Clothing orders Bowls Trader may request The Buyer to send a sample piece which is sent at The Buyers cost and liability. Bowls Trader will endeavour to return, at our cost, each sample to The Buyer, however, we cannot be held responsible for items lost when required to forward them on to our factory in Pakistan.

11.5 Bowls Trader is not responsible for the description or representation of the colour of all Ready-Made Clothing and is not liable for any difference(s). Bowls Trader will contact the third party and act on The Buyers half if a dispute is raised regarding this but we accept no responsibility on the outcome.

12. Artwork

12.1 Bowls Trader refers to Artwork to mean all visual images or text added to Custom-Made Clothing orders, to include (but not limited to); club/team badge, sponsor(s) or brand(s) logo(s), player name(s) or nickname(s).

12.2 All artwork submitted via the website is subject to approval by Bowls Trader. We reserve the right to reject artwork deemed poor or insufficient quality for manufacture. In these instances, The Buyer will have the right to Refund.

12.3 Alternatively we offer a redraw service for those wishing to have their artwork redrawn to a suitable quality for production.

11. Making Payment

11.1 We are able to accept payment directly through the website using a credit/debit card, via Paypal linked to our website or following checkout via BACS transfer or Cheque.

11.2 Cheques must be made payable to “Bowls Trader” and sent to our address detailed in clause 1.

11.3 All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us, your order will not be accepted and Bowls Trader will not be liable for any delay or non-delivery of your order. For the avoidance of doubt, you must make payments in full before your order can be processed.

11.4 In order to purchase Products using Paypal, you must submit valid PayPal payment login or Card Details during checkout. You warrant that the PayPal login you submit is yours and acknowledge you are subject to validation checks and validation checks. Bowls Trader will not be liable for any delay or non-delivery of your order should the payment be refused.

11.5 All payments will be in pounds sterling (£) and payment will be accepted using any of our acceptable payment and ordering methods. Payments can be made online during the order and checkout process.

11.6 We are not currently registered for VAT, therefore payments do not include VAT which is not applicable at this time.

12. Delivery

12.1 All orders will be delivered by our couriers or chosen postal service to the address you supply. We do not deliver to addresses containing PO Box numbers. We do not delivery to non-U.K. addresses without prior arrangement.

12.2 Our chosen courier for most Custom-Made deliveries will be Royal Mail (1^st Class Large Letter / Small Parcel or 48 Hour Tracked), although we reserve the right to change this. You will receive tracking details upon ordering so you can track your item. If the attempt of delivery is unsuccessful your order will be taken to a local depot for collection at your convenience.

12.3 Our chosen courier for most Ready-Made deliveries will be DPD (1-2 working days) or Royal Mail (1^st Class Large Letter / Small Parcel), although we reserve the right to change this. You will receive tracking details upon ordering so you can track your item. If the attempt of delivery is unsuccessful your order will be taken to a local depot for collection at your convenience.

ADD IN CLAUSES FOR OVERSEAS SHIPPING

13. Force Majeure
    
    13.1 Bowls Trader shall have no liability to you for any failure to deliver goods you have ordered or for any delay in doing so for any damaged goods delivered that is caused by any event or circumstance beyond its reasonable control.

14. Returns and Refunds

14.1 Custom-Made clothing orders are not accepted for Returns, except in cases where we are deemed liable for shortages or damaged goods.

14.2 Read-Made clothing orders are accepted for Returns within a 28-day period of the date of purchase.

14.3 For all Returned Goods, by way of a restocking charge, the Buyer shall pay to Bowls Trader a sum equivalent to £30 or 20% of the price of the Returned Goods (at Bowls Trader’s discretion).

14.4 The Returned Goods must not be worn (including tried on) and must be returned in their original unopened packaging.

14.5 Bowls Trader retain the right to refuse Returned Goods should we deem them to be unsuitable for resale.

14.6 The Buyer will pay for and arrange the Returned Goods and Bowls Trader will not be liable until receipt of the Returned Goods.

14.6 Refunds will be processed within 14 days of receipt of the Returned Goods.

14.7 Where you make a valid claim in respect of shortages or defects in an order and we are liable for the claim, we can at our option make up the shortages or replace the goods or refund the price of goods in question to you. Any refund will be made within 30 days of you giving notice to Bowls Trader. If you do not notify us accordingly, we shall not have liability and shall not be bound to pay for the goods.

15. Your Warranty

15.1 You warrant that the information given on your order form is complete and accurate.

16. Availability

16.1 We will notify you by e-mail or by phone if a product you have ordered is out of stock or if delivery of a product will be delayed. On receiving such an e-mail notification or phone call you may amend or cancel your order using any convenient method of communication as detailed in clause 2.

17. Data Protection Act

17.1 You agree to us retaining data in a manual and electronic format and to the use and processing by computers of such data provided by them the customer, in the course of the your order, on the understanding that this data is stored or processed in accordance to the Data Protection Act 1998.

18. Links

18.1 Links within this site to other websites are not covered by these terms and conditions. Bowls Trader has no control over any such websites; does not endorse the content, operators, products or services of such sites; and is not responsible or liable for any loss or damage caused or alleged to be caused by or in connection with use or reliance on any content, operators, availability, accuracy, quality, advertising, products, services or other materials on or available from such sites.

19. Limitation of Liability

19.1 Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our website. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit Bowls Trader liability for death or personal injury occurring as a result of Bowls Trader negligence.

20. Invalidity of Terms and Conditions

20.1 If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be disputed.

19. Governing Law and Jurisdiction

19.1 These Terms shall be governed by and construed in accordance with English Law and we agree to submit to the exclusive jurisdiction of the English courts.
